Toshiba m40-yp3 bios problem

Heyo,

When I turn on the laptop initially, it boots up but all the toshiba functions such as standby, fn key, brightness dont work. When I restart or shutdown, the laptop is frozen at the toshiba screen. I cannot get past the toshiba screen, but will work again after 15 minutes if I leave it off. So if I start from dead, it works fine but no toshiba functions, but if I shutdown or restart, I have to wait 15 minutes before I can get past the toshiba screen and boot into windows. could this be a thermal issue? Is there anyway that the bios chip overheats, is corrupt? Here are my specs.

toshiba m40-yp3 (canadian)
bios id : TOSHIBA Portable PC BIOS Version: Version 1.70
Insyde software MobilePRO Bios Version 4.20.09
chipset: intel 2590 rev 3
windows xp sp 2

alright im pretty sure its a thermal issue, anyway to fix it? open it up, clean the fans?
